These terms apply to JayCam, JayResize and JayVideoConvert — the apps published at jay.ph by Jayson Ng.

Apps from the App Store

Apps installed from Apple’s App Store are licensed to you under Apple’s Licensed Application End User License Agreement, together with the App Store’s own terms. Where anything on this page conflicts with Apple’s agreement for an app you obtained that way, Apple’s agreement applies.

Apps downloaded from this site

An app downloaded directly from jay.ph is licensed, not sold. You may install and use it on the Apple devices you own or control, for any purpose, personal or commercial. You may not sell it, rent it, redistribute it, or present it as your own work. You may not remove or alter any copyright or identifying notices. All rights not expressly granted are reserved.

No warranty

The software is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. No guarantee is made that an app will be uninterrupted, error-free, compatible with any particular device or camera, or that any defect will be corrected.

Limitation of liability

To the fullest extent permitted by law, Jayson Ng is not liable for any indirect, incidental, special, consequential or exemplary damages, nor for any loss of data, loss of footage, loss of profits, or loss of use, arising from or connected to the use of or inability to use an app — even where the possibility of such loss has been made known. Where liability cannot be excluded, it is limited to the amount you paid for the app in question, which for a free app is nothing.

Your files are your responsibility

JayResize and JayVideoConvert write new files and are built not to alter or replace your originals. Even so, keep a backup of anything you cannot afford to lose before running any batch. No app can guarantee the behaviour of the disk, the operating system, or another program running at the same time.

JayCam is a viewer, not a security service

JayCam displays video streams from cameras you already own and control. It does not record, does not monitor, does not alert anyone, and is not a monitored security or alarm service. Whether a stream is available depends on your cameras, your network and your internet connection, none of which are under its control. It should not be relied upon as the sole means of observing anything where a failure to see it would matter.

Purchases

Where an app offers a one-time unlock, the purchase is processed entirely by Apple through the App Store. Refunds are handled by Apple under its own policies, not here. An unlock covers the platforms stated on the app’s page through Apple’s Universal Purchase and is tied to the Apple Account that bought it.

Updates and availability

Apps may be updated, changed, or withdrawn at any time. There is no commitment to any particular release schedule, to continued availability, or to support for any given device, operating system version, or camera model.

Privacy

What each app stores, and where, is set out in its own privacy policy, linked from the app’s page.

Governing law

These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction over any dispute arising from them. Nothing here removes any right you hold under the consumer protection law of the country you live in, where that law says it cannot be excluded.
